1. General Provisions & Data Controller

2. Service Description & Provider Qualifications

2.1. The Online Training service provided through Models Trainer is prepared, managed, and executed entirely by Grzegorz Wichrzycki, the owner of Freebody Grzegorz Wichrzycki, who operates as a Certified Personal Trainer, Srength Training Instructor, and Biological Regeneration Instructor.

2.2. Requirements for Participation: To utilize the Online Training service, the Client must fulfill the following prerequisites:
• Submit a declaration confirming the absence of any medical or health contraindications to engaging in physical activity.
• Participate in the Online Training service entirely at their own risk (or under the explicit written responsibility and consent of a parent/legal guardian if the Client is a minor).
• Read, understand, and fully accept these Terms & Conditions.

2.3. Onboarding Process: The service regulations, health questionnaire, and liability waivers must be accepted electronically during the website signup process, or completed, digitally signed, and delivered electronically to the designated email address provided by the Data Controller (contact@modelstrainer.com or via modelstrainer.com).

3. Fees, Payment Terms & Digital Delivery

3.1. The fee for utilizing the Online Training service is a one-time upfront payment . All prices listed on the website are gross amounts and include any applicable taxes.

3.2. Payments are processed securely via PayPal . The Client is strictly obligated to settle the payment in full using the PayPal gateway before the service, custom plan preparation, or onboarding platform access begins.

3.3. Freebody Grzegorz Wichrzycki does not store or have access to the Client’s credit card numbers or financial login credentials; all transactional data is securely handled by PayPal.

3.4. Upon successful payment confirmation through PayPal, the digital onboarding sequence is initiated, and access to the software ecosystem (Trainerize and TiqDiet) will be generated.

4. Service Duration and Termination

4.1. The standard duration of the Online Training service cycle is 4 weeks.

4.2. During the 4th week of the cycle, the Client is required to contact Freebody Grzegorz Wichrzycki to express their intent regarding extending the cooperation for next training cycle.

4.3. If the Client does not explicitly state their desire to renew the service, fails to respond, or if contact cannot be established, the service and corresponding platform access will be automatically deactivated at the end of the 4th week.

5. Scope of the Online Training Service

The Online Training service encompasses the complete preparation and digital guidance of the Client's fitness program, which strictly includes:
• Designing a personalized workout split tailored to the Client’s specific individual goals.
• Continuous review and digital analysis of training parameters and progress.
• Regular workout plan adjustments and modifications based on ongoing performance feedback.
• Comprehensive dietary analysis and creation of an individualized meal plan based on current energetic needs and goals.
• Ongoing dietary adjustments based on body mass changes and structural body circumference parameters.
• Direct communication and continuous support channel with the trainer.
• Access to a dedicated client user account hosted on the Models Trainer training platform ecosystem.

6. Training Platforms & Technical Infrastructure

6.1. The Online Training service is delivered digitally through user accounts integrated into specialized third-party software platforms utilized by Models Trainer: ABC Trainerize and TiqDiet.

6.2. All system licensing and operational costs required to use these third-party platforms are fully included in the current retail price of the service. The Client will incur no hidden or additional software usage fees.

6.3. Models Trainer reserves the right to adjust service pricing. Existing clients will be notified of any changes via email at least one month in advance.

7. Intellectual Property, Health Waiver, and Liability Disclaimer

7.1. Copyrights: All workout exercise videos, descriptions, templates, and digital materials hosted on the training platforms are the exclusive intellectual property of Freebody Grzegorz Wichrzycki. Copying, distributing, sharing, or publishing these materials without explicit written consent is illegal.

7.2. Visualizations Only: Exercise materials provided by Models Trainer serve purely as a visual guide for proper exercise execution. They do not substitute for in-person medical or physical therapy supervision.

7.3. Health Liability Waiver: Freebody Grzegorz Wichrzycki accepts no liability for any physical injuries, acute illnesses, physiological traumas, or psychological issues sustained by the Client during the execution of the Online Training service. The Client acknowledges that fitness training carries inherent physical risks.

7.4. Health Status Updates: The Client is strictly obligated to instantly inform Freebody Grzegorz Wichrzycki of any new injury, medical diagnosis, trauma, pregnancy, illness, or deterioration of physical or mental wellbeing during the training process or while following nutritional guidelines.

7.5. Emergency Protocol: The Client must immediately cease exercising during any training session if they experience pain, dizziness, shortness of breath, injury, or general malaise. The Client must immediately notify gym staff, bystanders, or emergency medical services, and subsequently report the incident to Grzegorz Wichrzycki.

7.6. Assumption of Risk: The Client voluntarily assumes full personal responsibility for their participation in the Online Training program and confirms that their involvement is completely voluntary.

8. Refund Policy & Right of Withdrawal

8.1. Fees paid for the Online Training service are non-refundable once the preparation of the personalized training or dietary programs has commenced, regardless of whether the interruption is caused by Client illness, personal emergencies, injury, or other subjective reasons.

8.2. International Consumer Notice: Due to the highly customized and digital nature of the services (digital content tailored to individual specifications delivered immediately), the Client explicitly agrees and acknowledges that by requesting the immediate execution of the service and delivery of the custom fitness/diet plan, they waive their standard statutory 14-day right of withdrawal under EU/EEA consumer protection frameworks once the digital assets are generated and delivered.

9. Minor Policy (Users Aged 16–18)

9.1. The service is intended for independent adults over 18 years of age.

9.2. If a Client is between 16 and 18 years old, participation in the training process requires the formal, explicit written consent of a parent or legal guardian.

9.3. The parent or legal guardian must sign all onboarding documentation (Terms & Conditions, liability declaration, medical questionnaire) and provide valid contact information on the consent form.

9.4. Freebody Grzegorz Wichrzycki reserves the right to contact the parent or legal guardian directly via phone or email at any time to verify the authenticity of the participation consent.
